Terms of Use
These Terms of Use ("Terms") apply to your use of the Travel Spanish Buddy app for iPhone and iPad ("the app") and the Travel Spanish Buddy website ("the website"), both made by Designing Pixels ("we," "us," or "our"). By downloading or using the app, or by using the website, you agree to these Terms.
Your license to use the app is also governed by Apple's Licensed Application End User License Agreement (Standard EULA). These Terms add details specific to Travel Spanish Buddy.
Use of the app and website
Travel Spanish Buddy helps you learn practical Spanish for travel through lessons, role-play scenarios, adventures, a phrasebook, games for children and, in the app, translation tools. It is for educational and personal use only. You agree to use it only for lawful purposes and in line with these Terms. The website is free to use.
Translations and travel information
Conversation mode, Scan & Translate and other translation features in the app use automatic, machine-generated translation. Translations may be incomplete or wrong. Do not rely on the app or the website for medical, legal, safety or emergency communication, or to understand allergy or ingredient information. Show cards you create contain only what you type. In an emergency, contact local emergency services. We make no guarantees about language fluency, accuracy in real-world conversations, or travel outcomes.
Buddy Pro subscriptions (app)
Some features of the app require a Buddy Pro subscription, including additional units and travel adventures, and unlimited use of Scan & Translate and Conversation mode. Without Buddy Pro, Scan & Translate and Conversation mode can each be used 3 times per day; the allowance resets at midnight on your device. The website does not sell subscriptions; content marked Pro on the website is available through the app.
- Plans: weekly, monthly and yearly auto-renewing subscriptions. Current prices are shown in the app and on the App Store in your local currency.
- Free trial: the weekly plan may include a 3-day free trial for eligible new subscribers. Any unused portion of a free trial is forfeited when you purchase a subscription.
- Payment: payment is charged to your Apple ID account when you confirm the purchase, or when the free trial ends.
- Auto-renewal: your subscription renews automatically unless you turn it off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
- Managing and cancelling: you can manage or cancel your subscription in your Apple ID account settings (Settings › your name › Subscriptions). Cancelling stops future renewals; you keep Pro until the end of the current paid period.
- Refunds: purchases are handled by Apple, and refund requests go to Apple at reportaproblem.apple.com.
- Restoring: use Restore Purchases in the app to restore an active subscription on a new or reset device signed in with the same Apple ID.
In-app and on-site rewards
XP, pesos, streak shields, crowns, stamps, stickers and shop items are rewards with no cash value. They cannot be purchased with money, sold, transferred or exchanged. Rewards in the app and on the website are kept separately. They may be lost if the app is deleted, your device is reset without a backup, or you clear your browser's data for the website.
Your content
Show cards, saved phrases and other content you create are stored on your device. You are responsible for what you create and how you use it.
Intellectual property
The app, the website and their content, including lessons, scenarios, text, audio, graphics, design and the Taco mascot, belong to Designing Pixels and are protected by law. You may not copy, redistribute, modify or reverse engineer them except as the law allows. The fonts used on the website are licensed under the SIL Open Font License.
Third-party services
The app uses services provided by Apple, including the App Store, StoreKit, and Apple's speech recognition, translation and text-recognition frameworks. The website uses the speech voices provided by your device and browser. Your use of those services is also subject to their providers' terms and privacy policies.
Disclaimer
The app and the website are provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law.
Limitation of liability
To the fullest extent permitted by law, Designing Pixels is not liable for any indirect, incidental or consequential damages, or for any loss arising from your use of, or inability to use, the app or the website, including reliance on any translation. Some places do not allow these limitations, so they may not apply to you.
Changes and termination
We may update, change or discontinue the app, the website or any feature at any time. We may update these Terms; when we do, we will change the date above. Continued use after a change means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-law rules. Any dispute arising from these Terms, the app or the website will be resolved in the state or federal courts located in Texas, and you consent to their jurisdiction. This does not take away any rights you have under the consumer protection laws of the place where you live.
